DIN KYC Updation

Recently the Ministry of Corporate Affairs, Government of India, has introduced a new mechanism under which all the Directors are required to update their KYCs with the Registrar of Companies who have been allotted a valid DIN (Directors Identification Number) on or before 31.03.2018 and whose DIN is in "Approved" status by filling an "E-Form DIR-3 KYC" upto 31.08.2018 i.e.

If DIN allotted on or before 31.03.2018 + DIN Status is "Approved" Then

Requirements for the updations:
  1. Unique Personal Mobile Number and Personal Email ID would have to be mandatorily indicated and would be duly verified by One Time Password(OTP).
  2. The form should be filed by every Director using his own DSC
  3. Duly certified by a practicing professional (CA/CS/CMA)
  4. PAN Based Digital Signature for Indian Nationals and Name Based Digital Signature for Foreign Nationals.
Note:

Filing of DIR-3 KYC would be mandatory for Disqualified Directors also

Penalty:
  1. After expiry of the due date by which the KYC form is to be filed, the MCA21 system will mark all approved DINs (allotted on or before 31st March 2018) against which DIR-3 KYC form has not been filed as ‘Deactivated’ with reason as ‘Non-filing of DIR-3 KYC’. After the due date filing of DIR-3 KYC in respect of such deactivated DINs shall be allowed upon payment of a specified fee only, without prejudice to any other action that may be taken.
  2. Penalty of INR 5,000/- shall be levied on the directors who do not file Form DIR-3 KYC within the time period allowed for the same.
