WHAT?

FSSAI (Food Safety and Standard Authority of India) has been established under Food Safety and Standards Act, 2006 by Ministry of Health and Family Welfare. FSSAI has been created for laying down science based standards for articles of food and to regulate their manufacture, storage, distribution, sale and import to ensure availability of safe and wholesome food for human consumption.

Food License is required for those who wishes to start up a food business. License is granted on State or Central Level depending upon the volume of the business.

Food License is a certificate that the food being provided to the customer is safe and is of good quality. This builds up the satisfaction of the consumers in the products being sold.

Food license helps in expanding the areas of the business easily.
Funding
The creditworthiness increases if the license has been granted to the company and it help in getting the Bank Loans in future
Market presence
With the food license the product qualifies for using the FSSAI Logo on its packet which acts as an advantage for the product to be recognized more in the market
WHO?

It is mandatory for all food business operators whether be wholesalers, manufacturers, traders, suppliers, etc. As per the Food Safety and Standards Act, 2006 no person shall commence or carry on any food business except under a license/registration under the Act as may be required depending upon the Annual Turnover and the type of food business.

There are 3 types of FSSAI Registration
Basic Registration
(Turnover upto 12 lacs)
State License
(Turnover upto 20 Crores)
Central License
(Turnover more than 20 crores)
Basic Registration:
  • Hawkers or Itinerant Vendors or stall holders
  • Petty Retailers
  • Small scale or cottage or such other industries relating to food business or tiny food business operator having turnover of less than INR 12 Lacs/annum whose:
  1. Production capacity of food in all food processing units including re-labelers & re-packers does not exceed 100 Kg/Ltr per day
  2. Handling and processing of the Milk products in Dairy Units is upto 500 LPD or 2.5 MT per annum.
  3. In case of Slaughtering units capacity is upto 2 Large animals, 10 small animals and 50 poultry birds per day
State License:
TYPE OF BUSINESS ELIGIBILITY
Dairy units including milk chilling units 501 to 50,000 LPD of milk Or more than 2.5 MT to 2500 MT of milk solids per annum
Vegetable oil processing units Upto 2 MT/day and turnover above 12 lakh
Slaughtering units Large Animal (More than 2 upto 50/ day) Small Animal (More than 10 upto 150/ day) Poultry Birds (More than 50 upto 1000/ day)
Meat Processing units Upto 500 Kg meat per day Or 150 MT per annum
All food processing units including & repackers More than 100 kg/ltr to 2 MT/day. All grains, cereals & pulses milling units.
Storage (Except Controlled Atmosphere and Cold) Capacity upto 50,000 MT
Storage (Cold / Refrigerated) Capacity upto 10,000 MT
Storage (Controlled Atmosphere +Cold) Capacity upto 1,000 MT
Wholesaler Turnover upto 30 crores
Retailer /Distributor /Supplier/Caterer/Restaurant/Marketer Turnover upto 20 crores
Dhaba, Boarding houses serving food, Banquet halls with food catering arrangements, Home based Canteens/ Dabba Wallas, Permanent /Temporary stall Holder, Food stalls/ Arrangements in Religious gatherings/fairs/Fish/Meat/Poultry shop/Seller or any other food vending establishment /Club Canteen Turnover more than 12 lakhs/annum
Hotel Three star & above and below Five star Or upto Three star and Turnover more than 12 lakhs
Central License:

HOW?
  • Step 1: Application Form :- Registration under FSSAI can be applied online by submitting the prescribed application along with the prescribed application fees with the concerned department. Application fees is based on the requirement whether the same is basic registration/State License/Central License.
  • Step 2: Documentation :- Prescribed documents are required to be submitted to the Department along with the application form.
  • Step 3: Examination :- After Receiving the application, the authorities examines the application and carry out food inspection
  • Step 4: Registration Certificate :- After receiving satisfaction Inspection Report by the examiners, FSSAI license is issued by the concerned authority within a period of approximately 60 days.
Penalty for Non-Registration

As per the provisions of the Food Safety and Standards Act, 2006 If any person or food business operator himself or by any person on his behalf who is required to obtain license, manufactures, sells, stores or distributes or imports any article of food without license, shall be punishable with:

  1. Imprisonment for a term which may extend to six months and
  2. Fine which may extend to five lacs rupees.
