What Is The Process Of Trade Mark Registration In India?

Step 1: Check the official IP India database to ensure the brand name, logo, monogram, decided by you is not already registered.

Step 2: Submit your application online on website IP India E-Filing Portal. https://ipindiaonline.gov.in/trademarkefiling/user/frmLoginNew.aspx

Step 3: If your application includes a logo or artwork, the registry internally indexes its visual elements based on international design standards. Your status will show as Sent for Vienna Codification.

Step 4: The examiner will review your application & if he raises concerns will issue an examination report. The applicant must revert within 30 days.

Step 5: On acceptance of your application, the trademark will advertise online in a weekly trademark journal.

Step 6: The mark stays online for 4 months and if any other person raises an objection regarding the mark, legal bearing will take place & both the parties will bring their evidence.

Step 7: If you win the healing or no one raises an objection for 4 months, the registrar will issue the Trade Mark certificate.
